We all hate the cops, but lets not let that cloud our judgement as to what we just watched.

A kid not complying with an officers legal request for a frisk. You don't have to like the law but you have to obey it, no matter how unfair you may think it seems.

I wish the young man was my client, NYPD reserves the right to stop and ask you some bull!! questions however they must explain why the are stopping you. The officer is in idiot he violated the use or force policy, excessive force, he never read the gentleman his rights which was required immediately after restricting his movement. The officer never requested[..]istance nor informed his superiors of his situation until after the scuffle. the young man showed no aggression or resistance towards the officer. The young man should beat this case then sue the officer as an individual and as a city government employee, sue the Transit Authority for employing and training the officer. Lastly, subpoena the officer's training jacket, personnel folder, and subpoena the individual in charge of training for the Transit Authority.

He didn't violate the use of force at all. It was perfectly legal for the cop to do that because the guy is moving around when he is searching him. Any non compliance warrants the use of non lethal force. A frisk search isn't illegal as long as you have reasonable suspicion that a person is doing something wrong or part of a crime.

Where are you coming up with this stuff? A cop doesn't even have to read you your rights even if he arrested you, let alone a detainment. While being detained, a cop can ask you anything he wants without having to read you your rights. Not only until you are arrested, does a cop have to read your rights if they want to question you. Custody+Interrogation= Miranda.... So if you were arrested on DUI or drunk in public and there is nothing else for the cop to say, he doesn't even have to read you your rights because there is no questioning needed.

no man.where are u gettin your stuff from.in a case of stop and frisk, they have to have suspicion and tha search cant be invasive.they can literally only tap your pockets or waistline to check for a weapon.being that officer fondled this kids nuts, that was clearly an invasive search

I get what you are getting at. I know a stop and frisk is only for a search of weapons, doesn't necessarily mean a tap on the pockets though. If while searching for weapons you come across something else which you know is illegal, whether it's drug or whatever, you can seize it. Is it really clear that the officer fondled the kids nuts tho? The way I see it is that he was being frisk searched and the kid starts moving around, that's suspicion enough that the kid doesn't want something to be found on him which warrants being put to the ground.

a stop and frisk is not supposed to be invasive at all.it is how they help rationalize it.u can only tap pockets and check a waistline, and that is for officer safety.if an officer detains u,then they can do a more invasive search, but they have to let u know your bein detained.

yes its clear officer grabbed his nuts.u can hear tha kid scream it out.look at tha officer posture durin tha vid.he is gettin very aggresive for no reason whatsoeva, and this is beofre tha take down.tha kid said he did othin wrong so obviously didnt hop a turn style, and he was just standin there,so he obviously wasnt runnin from that officer

that is good police work and the reason crime is down heavy in the nyc, now if they let chi town cops do good police work maybe they could lower the crime rate there instead they only can carry pepper spray

Why do you[..]ume that it was a "Stop and Frisk"?.. Just because other niccas in this thread said it was?

All we know is when the video starts, something makes the cop want to frisk that one kid as opposed to EVERYONE else in the station.

For all we know, that cop had every reason to frisk that kid. Maybe he was a suspect in some sort of crime. Maybe he jumped the turnstile. We don't know.

But it's in our nature that when we see a white cop and a minority youth, we wanna[..]ume that the cop is doing something wrong or sneaky.

supervillain
thats how they do...when they frisk you they touch you in a way to get a reaction..then thats their q to rough you up and call it resisting arrest...i can tell half of you have never been frisked...this is not the same frisking done by the TSA and the bouncers at clubs.
