In 2002 the Supreme Court ruled that executing the mentally retarded violated the Eighth Amendment. The Court left it up to individual states to decide on what procedures to use when determining whether defendants were in fact mentally retarded, or were falsely claiming to be so.

Im definitely not applauding..nor did I take note on his skin color...nor to I applaud k#lling anyone.. As i did note there is a loophole, and he is within full right to utilize it to his advantage, but he clearly was level headed enough to know what he was doing.
