 Can I buy a cell phone off ebay and get it activated without signing a contract?

I was thinking about getting a G1 or Iphone off ebay but I wasn't sure if I could get it activated without a credit check or contract,does anybody know if you can do this? I'm willing to do the data plan but not a 2 year contract.

i just bought a blackberry bold off of amazon for $150 (a f**kin steal) and have no contract to abide by becuz in cali they dont require social checks but need a personal ID, so basically i get the phone wit no contract .. good luck wit that (i get the phone tomorrow)
